This website (the “Site”) is operated by USA Campervan, LLC (referred to as “USA Campervan” or the “Company,” “we,” or “us”). The terms “users” or “you” as used in this Privacy Policy, refers to all users of the Site. Information we collect about you will be used in the manner explained in this Privacy Policy.

Capitalized terms used in this Privacy Policy have the same meaning as in the Terms of Service for the Site (the “Terms”).   • Birthdate and gender
  • Geolocation
  • Images, videos, and other recordings
  • Social media account IDs and other publicly available information
  • Communications with us (such as recordings of calls with customer service representatives for quality assurance and training purposes)
  • Searches you conduct, transactions into which you enter, and other interactions with you on or through our Site
  • Other communications that occur through the platform and in group-chat tools
  • Data you provide about other people, such as your travel companions or others for whom you are making a booking
  • Information we receive about you from third parties such as our business partners and authorized service providers, which may include updated contact information, demographic information, interests, and purchase history, which information we may add to your account or profile and use for market research and analysis

 

When you use our platform, we automatically collect the following types of information from your device:

With Others in Connection with the Services: We may also share your personal data with our affiliated companies, other Users you have a prior or current business relationship with, our channel and distribution partners (such as Outdoorsy) and our other business partners in order for them to fulfill services that you requested.

Sale, Assignment or Change of Control: We may change our ownership or corporate organization while providing the Services. We may transfer to another entity or its affiliates some or all information about you in connection with, or during negotiations of, any merger, acquisition, sale of assets or any business, other change of control transaction or financing. Under such circumstances, we would request the acquiring party to follow the practices described in this Privacy Policy. Nevertheless, we cannot promise that an acquiring party or the merged entity will have the same privacy practices or treat your information the same as described in this Privacy Privacy.

 

Law Enforcement, Legal Process, and Emergency Situations:We may use or disclose your personal information if required to do so by law or on the good-faith belief that such action is necessary to (a) conform to applicable law or comply with legal process served on us or our Websites; (b) protect and defend our rights or property, the Websites or our users, or (c) act to protect the personal safety of us, users of the Websites or the public.

With Your Express Consent: With your consent, we may provide your personal information with other third parties not described here.

Aggregated Data Sharing: We may aggregate data about individuals who use the Services, meaning we combine and anonymize this information. We may share this aggregated information with third parties to help describe our business, analyze our marketing efforts, comply with regulations, obtain insights about our business practices, and refine the services we offer, and for other business purposes. When we share aggregated information, we do not share personally identifiable data about individuals.

The Site may contain links to third parties’ sites (“Linked Sites”). USA Campervan is not responsible for the privacy practices of Linked Sites. You should read the privacy policies on those sites carefully before either agreeing to their terms or using those sites. 

Opting out of Marketing Communications

We will contact you from time to time for marketing purposes. 
You may opt-out of receiving marketing communications from us by the following means:

  1. Contact us at support@usacampervan.com;
  2. Follow the instructions included in each communication; or

Please remember that if you change your preferences it may take a short time for those preferences to become effective.

Security of Your Data

We employ technical, administrative, and physical safeguards designed to protect the security of personal information. However, no security measure can guarantee security and that data will not be accessed, disclosed, altered, or destroyed by a breach of our safeguards. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a complex password that nobody else knows or can easily guess, and keeping your log-in credentials private. We are not responsible for any lost, stolen, or compromised passwords or for any unauthorized account activity.

 

Phishing and Email Scams

You should always be wary of any email that asks for your personal or financial information or messages that refer you to a web page asking for this information. Always ask yourself whether a contact from an apparently trustworthy organization might be a scam. If you receive an unsolicited email from USA Campervan or one of our Users that requests personal information (such as your credit card information or password), or that asks you to verify or confirm your account or other personal information by clicking on a link, that email was likely to have been sent by someone trying to unlawfully obtain your information. Unless you have specifically requested us to contact you to reset an element of personal information, we will not contact you to confirm the information in an email. If you receive a suspicious ‘phishing’ email, do not provide the information requested or click on any link provided in such email you receive. Please contact us at support@usacampervan.com if you receive any suspicious email from us or one of our Users.

Children’s Personal Information

Our websites are not directed to, and we do not intend to, or knowingly, collect or solicit personal information from children under the age of 13. In the event that we learn that we have inadvertently collected personal information from a child under age 13, we will delete that information as quickly as possible. We will update this Privacy Policy from time to time. When we make changes to this Privacy Policy, we will change the “Last Updated” date at the beginning of this Privacy Policy. If we make material changes to this Privacy Policy, we will notify you by email to your registered email address, by prominent posting on this Site, or through other appropriate communication channels. All changes shall be effective from the date of publication unless otherwise provided. Your continued access to or use of the Platform and/or Services will be subject to the revised Privacy Policy.

Do you use any other user tracking technologies?

USA Campervan may use other technology that is standard to the Internet, such as pixel tags, web beacons, and other similar technologies, to track visitors to our sites.

Do Not Track disclosure.

Do Not Track is a privacy preference that users can set in certain web browsers. When a user turns on the Do Not Track signal, the browser sends a message to websites requesting them not to track the user. For information about Do Not Track, visit www.allaboutdnt.org. At this time, USA Campervan does not respond to Do Not Track browser settings or signals. Internet-standard tracking tools may be used by us and by third parties to collect information about you and your Internet activity, as disclosed in our Privacy Policy, even if you have turned on the Do Not Track signal.

CALIFORNIA PRIVACY NOTICE

Effective: June 14, 2020

Pursuant to the California Consumer Privacy Act of 2018 (“CCPA”), this notice provides information regarding the personal information we collect about California residents and the rights afforded to such individuals under the CCPA.

As is described in this Privacy Policy, we collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or individual—otherwise known as “personal information.”

Under the CCPA, personal information does not include certain types of publicly available information from government records, de-identified or aggregated consumer information that is appropriately anonymized, or certain information excluded from the CCPA’s scope, such as health or medical information covered by HIPAA and personal information covered by certain sector-specific privacy laws, including the FCRA and GLBA.

We collect personal information from residents of California, such as renters of Campers and the owners of Campers. Over the past 12 months, we collected the following categories of personal information:

  • Payment information
  • Identity information
  • Contact information
  • Information provided during communications with USA Campervan
  • Information provided in connection with a booking 
  • Information obtained in connection with the Services
  • Information about your site visits
  • Device and browser information
  • Location information
  • Other information as required by applicable law

We collect and use such information for the purposes described in the How We Use Your Personal Data section above, including:

  • To fulfill the terms of a contract between you and us
  • To respond to your inquiries or requests
  • To communicate with you about reservations and stays
  • To fulfill contractual or legal requirements relating to your request or the Services you are using
  • To provide customer service
  • To provide Rental Services or similar services
  • To detect and prevent fraud or illegal activity
  • To make or receive payments from you
  • To optimize, customize and improve our services and your user experience
  • To conduct, measure, and improve our advertising and marketing
  • To comply with our legal and contractual obligations and for security and investigation purposes

For purposes of the CCPA, we do not sell personal information.

Exercising Your California Privacy Rights

The CCPA and other California law provide residents of California with the rights listed below. If you are a California resident, you may exercise your rights by submitting a verifiable consumer request by emailing us at privacy@usacampervan.com.

  • Right to Access: You have the right to know certain information about the data we have collected about you over the past 12 months, including:
    • The categories of personal information we’ve collected from you;
    • The categories of sources from which the personal information was collected;
    • The business or commercial purpose(s) for collecting personal information about you;
    • The categories of personal information about you which we shared and/or sold;
    • The categories of third parties we have shared or sold personal information about you to; and
    • The specific pieces of personal information about you that we have collected.
  • Right to Delete: You have the right to request that we delete certain personal information about you that we have collected from you (and request that we direct applicable service providers to do the same). Where an exception applies, we may not fulfill your request for deletion.
  • Right to Opt-Out: You have the right to opt-out of any future “sale” of personal information about you. You may do so by sending an email with this opt-out request to privacy@usacampervan.com
  • Other Rights: If you live in California and have an established business relationship with us, you are entitled to ask us for a notice describing what categories of personal customer information USA Campervan share with third parties or corporate affiliates for those third parties or corporate affiliates’ direct marketing purposes. That notice will identify the categories of information shared and will include a list of the third parties and affiliates with which it was shared, along with their names and addresses. 

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may only make a verifiable consumer request for access or data portability twice within a 12-month period.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Your verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify that you are (a) the person about whom we collected personal information or (b) an authorized representative of such person.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

You can submit a verifiable consumer request to us at privacy@usacampervan.com. Upon receiving your request, we will respond promptly. To the extent that we successfully verify your identity and determine that we will fulfill part or all of your request, we will complete the request within 45 days of receiving it, unless we require an extension, in which case we will inform you why we need more time and how much time we need.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

We will not discriminate against you for exercising any of your CCPA rights.

Changes to this Notice

We reserve the right to amend this notice at our discretion and at any time. When we make changes to this notice, we will post the updated notice on this page and update the notice’s effective date.
